METODE EVALUASI PERHITUNGAN GANTI RUGI AKIBAT PENGHENTIAN KONTRAK

Abstract

The construction project of the Raha 2x3 MW coal-fired power plant (PLTU) faced termination through a mutual agreement between PT PLN UIP Sulbagsel and PT Hutama Karya. This decision was driven by a change in the project location, which was expected to increase costs by 78% compared to the initial contract value. As a consequence of the termination, PT Hutama Karya (Persero) filed a compensation claim for the incurred losses. The total claim submitted amounted to IDR 6,106,149,297.61. After conducting a legal analysis based on the contract, a factual review, and a cost analysis—including an evaluation of evidence and applicable regulations—both parties agreed on a final compensation amount of IDR 2,660,054,347.
