Abstract

Construction work contracts are one of the most important aspects in the process of cooperation for the creation of a construction project. This is an obligation that must be prepared in accordance with Article 1, Paragraph 8 of the Construction Services Law No. 2 of 2017, which states that a construction work contract is the entirety of contract documents that regulate the legal relationship between service users and service providers in the provision of construction services. In practice, there are various types of work contracts, including conventional contracts, design & build contracts, lump sum contracts, unit price contracts, mixed contracts, and others. Each type of construction contract has its differences; thus, this research will examine the comparison of the most commonly used work contracts in the construction business world, namely conventional work contracts and design & build contracts
