Abstract
The construction of hospitals is a critical infrastructure project that requires strict adherence to legal regulations to ensure the safety, quality, and functionality of the building. In Indonesia, the construction of hospitals is governed by various laws and regulations, including Law No. 2 of 2017 on Construction Services and Regulation of the Minister of Health Number 40 of 2022 concerning Technical Requirements for Hospital Buildings, Infrastructure, and Health Equipment. However, the implementation of these regulations in hospital construction projects often faces significant legal challenges, such as contract disputes, non-compliance with technical standards, and environmental violations. This paper aims to provide a juridical review of the legal aspects of hospital construction in Indonesia, focusing on the compliance with applicable laws, risk management, and dispute resolution mechanisms. Through a normative legal research methodology, this study examines relevant legal frameworks, case studies, and judicial decisions related to construction disputes. The findings suggest that while legal regulations are in place, challenges in enforcement, monitoring, and understanding of these regulations hinder the smooth execution of hospital construction projects. The paper concludes with recommendations to improve compliance with legal standards, enhance government oversight, and promote alternative dispute resolution mechanisms to address legal issues efficiently. Ultimately, strengthening the legal infrastructure in the construction sector is essential to ensure the successful and safe development of hospital facilities in Indonesia.
