APPLICATION OF LAW IN THE DYNAMICS OF LEGAL CHANGE (CASE STUDY OF ENVIRONMENTAL PERMITS ON THE DUKU BIM BRIDGE CONSTRUCTION PLANNING PROJECT IN WEST SUMATRA PROVINCE)

Abstract

Based on (Law 38 of 2004) that roads and bridges as part of the national transportation system have an important role, especially in supporting the economic, social and cultural fields as well as the environment through a regional development approach in order to achieve equitable development between regions and balance. The laws and regulations regarding roads and bridges are strengthened by their derivatives: PP No. 15, 2005, Minister of Public Works Regulation No. 75/PRT/M/2005, Minister of Public Works Regulation 25/PRT/M/2005, Minister of Public Works Regulation No. 392/PRT/M/2005 , and PP No. 34 of 2006. Special Study, namely that the researcher carried out the PPC-5 Bridge planning project for the Ministry of PUPR with assistance from ADB for the Sumatra region, a special review of the Duku BIM Bridge/Fly Over in West Sumatra province, regarding the process of applying for an environmental permit among the old regulations of Law No. .32 of 2009 and the issuance of new regulations Law No.11 of 2020 in the midst of the implementation of the above project, have implications for changing document administration processes and licensing issuance times. This research is descriptive-analytic in nature, namely by describing the data studied systematically and using a normative juridical approach, namely this research is based on statutory regulations as positive legal norms which are the basis. Data analysis uses qualitative descriptive methods. So it is hoped that the negative impacts arising from the dynamics of changes in this law will become a driving force for improving the law in the future.
