ANALISIS PEMUTUSAN KONTRAK DAN ALTERNATIVE DISPUTE RESOLUTION PADA PROYEK PEMBANGUNAN SUTET 275 KV PHI INCOMER MUARA ENIM JALUR 1

Abstrak

The construction of the 275 kV Phi Incomer Muara Enim Extra High Voltage Overhead Line (SUTET) is part of Indonesia's National Strategic Project (PSN) aimed at strengthening the country's electricity infrastructure. However, the project faced significant land acquisition challenges, leading to the termination of the contract. This study examines the legal risk management and application of Alternative Dispute Resolution (ADR) mechanisms in the termination process, using a qualitative case study approach. The findings indicate that the termination of the contract was conducted based on mutual agreement between the owner and the contractor, ensuring no disputes arose during or after the process. The collaborative approach, grounded in clear legal and contractual frameworks, highlights the effectiveness of ADR methods such as mediation and negotiation in achieving a fair resolution. This article provides recommendations to improve risk management and ADR implementation to support the success of strategic infrastructure projects.
